These Terms of Service govern your access to and use of Diti’s website, platform, software development kits, and related services (collectively, the “Service”). By using the Service, you agree to these terms on behalf of yourself or the organization you represent.
Your account
You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity that occurs through your account and for ensuring that your authorized users comply with these terms.
Permitted use
Subject to these terms and any applicable order form, Diti grants you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes. You may not copy, modify, reverse engineer, resell, disrupt, or misuse the Service, bypass access controls, upload malicious code, or use the Service in violation of applicable law or another person’s rights.
Your data and experiments
You retain ownership of the data and content you submit to the Service. You authorize Diti to process that data only as needed to provide, secure, and support the Service. You are responsible for obtaining any permissions, notices, and lawful bases required for the data and experiences you test using Diti.
Fees and payment
Fees, billing periods, taxes, and payment terms are stated in the applicable checkout, order form, or written agreement. Fees are due as stated there. Refund and cancellation rules are in our Refund & Cancellation Policy. Third-party payment providers process payments under their own terms and policies. If an order form conflicts with these terms, the order form controls for that purchase.
Intellectual property
Diti and its licensors retain all rights, title, and interest in the Service, documentation, branding, and related technology. Feedback you provide may be used by Diti without restriction or compensation, provided we do not identify you publicly without permission.
Availability and changes
We work to keep the Service available and reliable, but do not promise uninterrupted or error-free operation. We may modify, suspend, or discontinue features when reasonably necessary to operate, secure, or improve the Service. Material changes to paid services will be communicated when practical.
Disclaimers and liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Diti disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenues, or data. Diti’s total liability arising from the Service will not exceed the fees paid by you for the Service during the 12 months before the event giving rise to liability.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these terms, create a security risk, or use the Service unlawfully. Provisions that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and payment obligations, will survive.
Changes and contact
